1. Definitions

  • Site: The website www.giannettoportofino.it, managed by the Owner, offering clothing products via e-commerce.

  • Products: Goods and/or services offered on the Site.

  • User: Any individual or entity accessing the Site, regardless of legal status or intent.

  • Consumer: A natural person acting for purposes outside their trade, business, or profession.

  • Conditions: This agreement, governing the relationship between the Owner and Users and the sale of Products.

2. Agreement Conclusion and Effectiveness

A purchase contract is concluded when the order form is accurately completed and submitted. The confirmation includes details of the buyer, product(s), prices, applicable taxes or fees, delivery address, and delivery timeline.

The Owner will confirm receipt by email or a web confirmation page.

Changes to these Conditions will only affect future orders. Users are encouraged to review the Terms before each purchase.

3. Purchasing on the Site

Products are available for purchase by both Consumers and non-Consumers. Buyers must be at least 18 years old.

The Owner makes every effort to present the Products accurately but cannot guarantee the absence of minor discrepancies.

Orders may be partially accepted if some items are unavailable. The Owner may reject orders due to unavailability, payment denial, or obvious pricing errors.

4. Prices and Payment

Prices include VAT (if applicable). Additional costs (e.g., shipping, customs duties) are shown before purchase confirmation and are the responsibility of the User.

Payments can be made by bank transfer or credit card. Refunds will be processed promptly, and no later than 14 days from the Owner's acknowledgment of a return.

The Site uses third-party payment processors and does not store payment details. If payment is denied, the Owner cannot fulfill the order.

5. Invoicing

Invoices are issued based on the User-provided data, which must be accurate. The Owner is not liable for errors resulting from incorrect User information.

6. Delivery of Physical Products

Products will be shipped to the address provided by the User, following the delivery terms outlined at the time of purchase.

Users must check product conformity upon receipt before signing delivery documents. In case of stock shortages, the Owner will notify the User and offer alternatives or refunds.

The Owner is not liable for delays caused by force majeure events.

7. Right of Withdrawal

Consumers may withdraw from the contract within 14 days of receiving the Product, without penalty and without providing reasons.

Exceptions: Products made to measure or clearly customized.

Refunds will be processed within 14 days, using the same payment method, excluding delivery charges. Products must be returned in original condition, at the User's expense.

8. Optional Withdrawal Form

Products sold to Consumers are covered by legal conformity guarantees under Italian Consumer Code (Articles 128–135). Non-consumer purchases are covered by applicable civil code guarantees.

10. Intellectual Property

The Owner retains all intellectual property rights to the Site content. No license is granted unless otherwise stated. Unauthorized use will be pursued legally.

11. Limitation of Liability

The Owner is not liable for:

  • Fraudulent use of payment methods by third parties.

  • Losses not directly caused by a breach of contract.

  • Indirect damages such as lost revenue, business, or reputation.

The Owner’s liability is capped at twice the amount paid by the User.

12. Force Majeure

The Owner is not liable for failure to fulfill obligations due to events beyond its control (e.g., natural disasters, network outages, strikes). Performance is suspended during such events.

The Site may contain links to third-party websites. The Owner is not responsible for the content or services of these sites.

14. Severability

If any provision is found invalid, the remaining terms will continue in full force.

15. Governing Law and Jurisdiction

These Conditions are governed by Italian law. Any dispute will be subject to the exclusive jurisdiction of the courts located where the Owner is based.
